Ethics and Translation
As many of you know, I teach in UEA’s MA program in literary translation. We tend to talk about ethics in class because, you know, it’s rather relevant to what the students want to do with their lives. One of the students (who shall, of course, not be named) in the past few years complained to me that we talked too much about ethics and that it actually had nothing to do with translation.
This student made this comment at the end of the academic year, when the cohort had spent quite a bit of time discussing issues such as translating for readers without much power or control (such as children or a minority group) or what to do when faced with potentially challenging situations (such as whether to take a job translating a porn film, or whether to agree to interpret for someone on trial, or how to handle the translation of a racist/anti-Semitic/otherwise prejudiced text, or even how to deal with a client who wasn’t paying).
I was genuinely shocked that a student who had spent a year in an intense MA program was arguing that ethics had nothing to do with their chosen career, and I was left feeling as though this person couldn’t have gotten much out of their studies.
What do you think about ethics and translation? Is it an important topic to discuss? What ethically sticky/challenging situations have you come across in your time as a translator?

Charitable Feelings and Translation
For example, I organized and edited the Bryn Mawr College Cookbook, a project that took months. All the proceeds went to my alma mater. I must confess that I was a bit surprised and offended when the college wrote me later that year to urge me to donate money to the school; I did a quick calculation and found that the time I’d spent putting the book together equaled several thousands of dollars worth of donations to the school, and that didn’t even include the time others had donated to the project or the proceeds the school received. Still, I was happy to do it.
But a university is not a charity. I’ve also done writing, editing, and translating for charitable organizations and for individuals, as a way of offering them some professional help that they might otherwise have had to pay for.
During this holiday season, I urge you to do likewise. If you can spare just a little of your time and your talents to help someone or an organization, I am sure that would be much appreciated.

End of the Semester Reflections
My teaching this semester has focused on children’s literature and on literary translation. I had 60 undergraduate students studying children’s literature and of course I made sure that we looked at texts for children from cultures other than English-speaking ones and that we discussed translation issues. In the MA course in literary translation, we looked at different genres, including children’s literature, drama, and detective fiction, with a brief foray into historical texts.
Besides the slight overlap in subjects, I noted that there was an overlap in the discussions the various classes had. Something that came up over and over again was power and the related issue of ethics. For example, in children’s literature, adults (in the form of authors, editors, translators, publishers, booksellers, librarians, parents, and teachers, among others) have power over the child readers (or the read-to) in terms of deciding what texts are available for them and how those texts tackle different topics. In translation, translators have power over their target audience in terms of what texts we make available to them and how, and editors and publishers and authors frequently have power over the translators in regard to strategies and approaches to translation.
That is to say that we must be aware of ways in which we might abuse our privileged positions, especially as adults and as translators. It’s easy to forget that we have this power, because we often complain about being overworked, underpaid, and invisible. But after having spent three months interrogating this subject in detail with my students, I am reminded that we would do well to always consider how our actions might affect others, whether in a translation or in some other way.

Changing Biblical Sexual References in Translation
“Generally speaking, when Bible translators have happened upon sexual references, they have been assiduous in seeking out neutralizing euphemisms like men with a mission to protect unborn generations of virginal Sunday School teachers. Thus is ‘penis’ changed in every instance to ‘thigh’. ‘Put, I pray thee, thy hand under my thigh,’ Abraham asks his servant in Genesis, ‘and I will make thee swear by the Lord, the God of heaven, and the God of earth.’ (This is a reference to the custom of ‘testifying’, by which anyone taking a vow places their hand on their testicles.” (138)
Of course, he doesn’t specify which translations and translators he’s talking about, but at least it’s good to see issues of translation crop up in a variety of works. And it’s important to remember that ethical issues, in terms of what translators change and why, have been around for a very long time and still are.

A Word on the Ethics of Blogging
I know many other blogs do have patron programs like this, but this is not a route that I want to take. I’d rather offer my readers information and resources that I think could be genuinely of use. Otherwise, for me, there is no point to this blog.
So I just wanted to mention this both so my readers know what they can expect to get from Brave New Words and so potential patrons know I am not interested. That doesn’t mean that I don’t want to receive suggestions for topics or websites, because of course that could be very beneficial; it just means that I’m not going to accept money in exchange for posting about something that is not relevant or helpful or true.

Here, Swedish author Kerstin Ekman discusses translation.
And finally, this article, which is in Swedish, is about the team-translation effort, if it can be called that, in which Dan Brown’s latest book was divided into sections and translated by a number of different people. Doesn’t say much for the quality, probably, but does reveal some of the challenges involved in translating fiction. English-language publishers don't want foreign-language authors to have access to manuscripts, because naturally they want to sell as many copies in English as possible. So they hope that by having English-language books, such as by best-selling authors J.K. Rowling and Dan Brown, only available in English initially, readers around the world will buy the books, even if they would be more comfortable reading in their native tongue. This then puts pressure on foreign-language publishers to get translations out as quickly as possible and as soon as they finally get access to the source texts, and this leads to team-translations and other time-cutting maneuvers.

Ethical Concerns, Or, Being Plagiarized
Ethics are important in every job. In our field, our customers rely on us to be the experts, especially as they may not have the knowledge to check over our work. It is up to us to make sure we translate the words correctly, edit the text multiple times, and so on. Doing something incorrectly or sloppily can cause a lot of damage for our clients.
So I can’t help but wonder what it means for their clients when a translation company plagiarizes and doesn’t seem to be overly concerned about ethical and legal behavior. It could very well imply that said company doesn’t have good oversight and that they don’t care about doing things the right way. That’s bad news for the company’s clients.
A few weeks ago, I was made aware that a British translation company called Merlin Translations (I won’t link to them, so as not to give them additional traffic) was plagiarizing me. They post this blog on their website so that it looks like they themselves do all the work of researching and crafting these posts.
I emailed them. A manager claimed not to have been paying attention to what an employee was doing. That suggests a clear and worrisome lack of supervision that shouldn’t exist in any company, including a translation company. I said that either they could credit me for each post they used or else they must remove all my content from their site. Not only have they made no improvements to the situation, but they also have continued to post the content from Brave New Words.
I’m a person who works hard at what I do. I take my work as a translator, writer, and editor very seriously. I also enjoy making knowledge about translation more widely available via this blog. So it is disappointing and upsetting to me personally when I am being plagiarized in this way. But on a bigger scale, the fact that a company that provides services to clients would use unethical means to try to make themselves look better (that is, increasing the material on their website by plagiarizing others) is disturbing indeed.

A Debate on Children’s Literature
Earlier this year, Dagens Nyheter criticized Vilda for the way it marks books as though they were organic or free-range products and for the ideology that runs through them. This set off something of a debate in the Swedish media and among Swedish children’s authors and illustrators of children’s books. So the debate on the 16th focused on art versus ideology, commercialism, and what children’s books are instruments of/for.
Kristin Hallberg felt that children’s books “create a meeting” between text/author and reader. She said they shouldn’t have morals or points or be used for a specific purpose. Others agreed that it should be about the story and if the story happens to teach or comfort or do anything else, that’s fine, too. Obviously, Karin Salmson thought differently. She felt that it was important to have books with gender equality, race quality, etc. Some participants, including some audience members who spoke, agreed that it was important for all children to feel they were “reflected” in books (i.e. that there were books about people like them), but that marking books or having requirements for books might be going a bit far. Then the issue of whether ideology affects quality was raised, but no final points were made regarding this.
Another topic that came up was Dagens Nyheter’s recent list of the 100 most important children’s books. About 1/3 of the books were by Swedish writers, mostly modern ones, and the rest of the books were primarily classics from the western world. Some felt that it was strange that so few Swedish books were on it, while others felt that too many were. Others thought older Swedish books and more modern foreign books were ignored. My own annoyance with the list came from the fact that for foreign books that had been translated to Swedish more than once (which is often the case for classics, such as Alice in Wonderland), the newspaper simply wrote “multiple translations available”. As we translators know, translations can vary wildly in quality, and therefore I think it is important that if one recommends a book in translation, one also recommends which translation is best.
It was an interesting evening and I hope there will be future debates on children’s literature, both in Sweden and elsewhere. Over 100 people were in the audience and it was great to see how many people are actively engaged in and concerned about the field of children’s literature.

A Smooth Lawn, Not a Volcano
“It’s the birthday of Constance Garnett, born in Brighton, England (1861). She gave us many of the first English translations of famous 19th-century Russian novels. Garnett could translate 5,000 words a day, scattering piles of pages at her feet as she wrote. She finished Tolstoy’s Anna Karenina in six months, and translated a total of 80 volumes, including Dostoyevsky’s complete works, which alone add up to about two and a half million words. But Garnett had a habit of skipping phrases that she didn’t understand, she often missed the humor of the original Russian, and she altered sexuality in the novels to reflect her Victorian ideals. Critic Kornei Chukovsky compared her writings to “a safe blandscript: not a volcano... a smooth lawn mowed in the English manner — which is to say a complete distortion of the original.” Constance Garnett’s translations held up as the standard for decades, but now most of them are replaced by more nuanced versions of the Russian works.”

A Question of Ethics: Subcontracting Work
I understand his point, but I don’t often see that kind of behavior (I mean the kind he recommends) in freelance work. Someone is hired to do a job and is therefore responsible for the end product, whether it is good or bad; if he or she subcontracts it out, that is fine, but the end customer usually isn’t aware of that. If the end customer wants to use the same freelancer for future projects, it is probably more honest of the freelancer to say who actually did the previous assignment, but I don’t think it is always necessary. It could be that the freelancer was particularly busy at that time or didn’t specialize in the appropriate area; she or he could feel that this new project is right for her or him for whatever reason, so there is therefore no real need to mention who did that other project.
I do know some people who generously pass on clients, especially if the client was very pleased with the work a subcontractor did, and I also know people who prefer to keep the client, but who keep subcontracting out work from that client, sometimes even giving the subcontractor the entire fee and not just a portion of it. Other freelancers occasionally make sure the subcontractor gets credit; I did this with a recent assignment, and both my name and that of the freelancer I hired were featured in the final product, though there was no direct contact between the customer and my subcontractor. So there are a variety of ways of handling such a situation.
Don’t get me wrong – I am all in favor of treating freelancers (including, obviously, subcontractors) well, and I also believe strongly in accepting only assignments for which I am skilled, which means that if I hire someone to do a job for which they are better suited, then it would be better to let them have the client contact, so they can continue to do that kind of work while I can do other assignments. I just think the issue is more complicated than Mr. Cohen let on (or could have let on, given the length restrictions of his column).

Translation and Journalism
The NY Times had a short piece from the Public Editor about this awhile back, focusing on the use of interpreters in reporting from other countries, but I don’t think this is a matter that most readers think much about. Wouldn’t it be useful to have a second byline, or even a sentence at the end of the piece, saying who performed the interviews and in which language or who translated the texts that were mentioned and how the translator went about it? Not only would that increase the translator’s visibility, but it would also remind readers that not everyone speaks English and that it is worth thinking about how the people or documents – the items that make up the news, that is – quoted in the article were shaped by the culture and language that they come from.

More on the Ethics of Translation
In Sunday’s column, a woman writes that her father, a translator, was hired to translate pages from a diary of a woman whose husband suspected she was cheating on him. Was it ethical to translate the diary pages? Mr. Cohen says that the translation was legal, but not moral.
I agree with his assessment and I hope I would have turned down the assignment, but the fact is that translators don’t always get to see (or know much about) the work before they accept it, although certainly a translator could turn down the job once she or he sees the document in question. Also, some freelancers might truly be desperate for money and unable to say no to any work.
What do you think? Would you have accepted this job? When does something cross the line for you from being an acceptable job to one you feel obligated to refuse?

Sample Codes of Ethics
Just to go back briefly to the codes of ethics topic, here are a few sample codes that some translators’ associations have. I’ve looked at codes from a pretty interesting variety of groups.
American Translators Association
The National Association of Judiciary Interpreters and Translators
The Association of Translators and Interpreters of Nova Scotia
Sveriges Facköversättarförening (Look under “Nyheter” at “God yrkessed,” if you can read Swedish)
Nearly all the codes I’ve seen emphasize that translators need to have good skills, not accept work that is beyond their abilities, keep information about clients and customers confidential, be accurate, and make other such expected suggestions. Only the ATA has any sort of code for clients and their guidelines are worth repeating:
“A. I will put my contractual relationship with translators and interpreters in writing and state my expectations prior to work.
“B. I will adhere to agreed terms, payment schedules, and agreed changes, and will not capriciously change job descriptions after work has begun.
“C. I will deal directly with the translator or interpreter about any dispute. If we cannot resolve a dispute, we will seek arbitration.
“D. I will not require translators or interpreters to do unpaid work for the prospect of a paid assignment.
“E. I will not use translators' or interpreters' credentials in bidding or promoting my business without their consent or without the bona fide intention to use their services.
“F. For translations for publication or performance over which I have direct control, I will give translators recognition traditionally given authors.”
It is important to note that even if some translation agencies join translators’ associations and follow these rules, the great majority of a translator’s clients are not members (unless said translator only works for agencies that are corporate members, though not all, or even most, agencies join such associations) and thus are not aware of these codes, nor feel bound to them. So the question remains for how to better educate clients and/or to only work for clients who treat their translators with the respect they deserve.

Codes of Ethics
Many translators’ associations do have codes of ethics or recommendations for professional conduct, but often such rules are rather basic. Such codes might say that translators should only translate to their native languages, or that they should be certain that they possess the necessary knowledge (such as specific terminology) before they accept an assignment, or that they should protect the customer by not using the text to be translated, the client’s personal information, or any other details in any way that does not strictly have to do with the job. But these kinds of codes or rules, which deal mainly with practical issues and are thus helpful in that regard, generally leave out two important topics.
First, they give no advice or suggestions on what translators should do if they face ethically risky situations. For example, what should a translator do if asked to translate a text that is specifically supposed to show the client’s language skills? Maybe a client is applying for a job in France and has to be fluent in French but instead writes his application essay in English and asks a translator to translate it to French. Is that ethical? Some translators might argue that such a client is only hurting himself by misrepresenting his language skills and that it is not up to them to point this out to him, whereas others might feel that they have a responsibility to turn down the job. To take a more serious example, what should a translator do with a racist text? Some translators might say they have a duty to make all texts available in other languages while others might refuse to translate a racist document, claiming that it incites people to hatred and possibly violence. Codes of ethics are, unfortunately, basically silent about these very important issues.
The second major topic left out of codes of ethics is the role of the client. If translators are expected to follow rules, why shouldn’t their clients? Too often I hear stories – or experience such things myself – about customers who try to cheat translators by not paying the correct amount, or not paying on time, or who expect translators to do more than is actually the job of a translator. Some codes do have recommendations for employers of translators, but these recommendations are generally rather basic as well, and they're not that common anyway. Many translators’ associations have corporate members and it would make sense to have ethical rules that these agencies and companies need to uphold. Then, if they do not follow the rules, they can be fined, or removed from the association, or translators can be warned about them (there should be similar consequences for translators who do not follow their ethical codes, too). Too often, corporate clients take advantage of translators and this must change. I suspect that some clients simply don’t understand translation and therefore don’t know how to work with translators, so having regulations or advice for them would educate them and help both them and the translators who work for them.
While I think it is great that translators’ associations have some advice on ethics and other information on professional conduct, I also think these codes are too limited and need to be further developed.

Translators and Ethics
What is a translator’s ethical role? Should translators simply translate whatever a customer gives us? Is it our job to simply make all texts available in other languages? Or do we have an obligation to speak up if we disagree with something or if we are concerned about the affect the translation might have on the audience?
Every week, in the New York Times Magazine, a man named Randy Cohen answers questions on ethical issue. I enjoy his column, which is called The Ethicist, and was happy to see a question on interpretation last Sunday.
Someone asked:
“Some time ago I was working as a court interpreter, translating what is said in court for the defendant and what the defendant says for the court. During a recess, the defendant confided that he did commit the crime and intended to take the stand and lie about it. I sought the advice of a colleague, who then informed the judge. As a result, I was chastised and lost my job. Was I wrong to divulge this information? E.N., Seattle”
Mr. Cohen responded:
“You were. Even if you made no explicit pledge of confidentiality, your role as an interpreter invites the defendant to confide in you, a relationship that does not terminate during a recess, out in the hall by the doughnut cart.
“The connection you've cultivated — emotionally, psychologically — endures. Unless you cautioned the defendant that you might disclose what he said, you abused his trust and your position.
“Robin G. Steinberg, executive director of the Bronx Defenders, a public defenders' organization in the Bronx (well, they would be), says of interpreters: "They become the only bridge between the attorney and the client. Those confidential communications can only occur with the interpreter, and those conversations are, indeed, confidential. There would be absolutely no way for a client to know that communications s/he makes just to the interpreter are subject to disclosure."
“Steinberg is right. A defendant naturally sees you as a quasi member of his legal team, someone to whom he can speak freely. Moreover, his requiring an interpreter indicates that he has limited facility with English and so is isolated in the court setting, making him even more apt to be candid with someone who speaks his language.
“What you could have done was speak to the defendant's lawyer. Generally, in the United States, if a client baldly announces an intention to lie on the stand, his lawyer is ethically bound to prevent him. Here in New York State, if a lawyer is unable to do that, he or she may, but is not required to, speak to the judge.
“While you acted badly, your colleague acted worse, imperiling the defendant and betraying your trust. I'm surprised that the judge spared him a sound thrashing, if that remedy is available under Seattle law.”
